Brian Goodrich’s case is moving to Schoharie County Court.
District Attorney Susan Mallery said Monday that waivers were signed last Wednesday in Fulton Town Court to move the case on Mr. Goodrich, who’s accused of firing shots in West Fulton the night of March 19.
“We want to handle something of this level in County Court,” Ms. Mallery said.
State Police said Mr. Goodrich used a hunting rifle to fire shots from his vehicle along West Fulton Road.
Bullets struck the self-serve store at Sap Bush Café, an above-ground pool at a residence and the West Fulton Firehouse, troopers said.
No one was injured.
State Police charged Mr. Goodrich with one count of second-degree criminal mischief, a felony, two counts of third-degree criminal mischief, which are felonies, and having a large-capacity ammo feeding device, a misdemeanor.
Up next, Ms. Mallery said, is a conference with Mr. Goodrich’s attorney and County Judge George Bartlett “to see if we can reach an agreement,” or plea bargain.
“If we can’t reach an agreement, we’ll indict,” Ms. Mallery said.
